本政策中，来也科技指北京来也网络科技有限公司及其通过股权或协议控制的法律实体，包括但不限于来也科技（北京）有限公司、湖南来也科技有限公司、来也（张家港）智慧城市科技有限公司、上海来也伯特网络科技有限公司、来也伯特科技（深圳）有限公司、北京小来无限科技有限公司等。

For the purpose of this Policy, Laiye Technology refers to and represents Beijing Laiye Technology Co., Ltd. and all legal entities under its control by equity or agreement, including but not limited to, Laiye Technology (Beijing) Co., Ltd., Hunan Laiye Technology Co., Ltd., Laiye (Zhangjiagang) Smart City Technology Co., Ltd., Shanghai Laiye Bert Network Technology Co., Ltd., Laiye Bert Technology (Shenzhen) Co., Ltd., Beijing Xiaolai Infinite Technology Co., Ltd., etc.  

二、我们如何定义个人信息

II. How we define personal data

来也科技将任何以电子或者其他方式记录的与已识别或者可识别的自然人有关的各种信息（不包括匿名化信息）视为个人信息。

All information relating to an identified or identifiable natural person (excluding anonymised information), that is being recorded electronically or otherwise, will be referred as Personal Information by Laiye Technology.

来也科技可能通过管理和技术手段，将个人信息进行去标识化或匿名化处理，使其在不借助额外信息的情况下无法识别特定的自然人，或使其无法识别特定自然人且无法复原。为避免歧义，本政策项下的个人信息不包括去标识化或匿名化处理后的信息。

Laiye Technology may engage management and technological tools to de-identify or anonymize personal data, so that it neither can be used to identify a specific individual without additional information, nor can be used to identify a specific individual or recovered. For the avoidance of doubt, the personal data hereunder does not include de-identified or anonymized information.

我们在设计和运营产品、服务和网页的过程中，已努力将收集个人信息的范围最小化，即我们在一般情况下，仅收集向您提供产品、服务和网页所必要的个人信息。我们将在隐私政策特别提示中对特定产品、服务和网页中收集个人信息的范围、目的和其必要性进行详细说明。

In the process of designing and operating products, services and webpages, we aim to minimize the scope of personal data being collected. That is, generally we only collect personal data that is necessary for providing you with products, services and webpages. In the Special Reminders for Privacy Policy, we explain in detail the scope, purpose and necessity of collecting personal data for specific products, services and webpages.

在您使用来也科技产品、服务和网站的过程中，我们可能向您收集您的个人信息，也可能通过其他渠道收集您的个人信息。其他渠道可能包括：

When you use Laiye Technology’s products, services and websites, we may collect your personal data from yourself or through other channels. Other channels may include:

1) 其他自然人。这通常发生在其他自然人向您寄送来也科技的产品、邀请您参加来也科技的活动、或向您分享来也科技发布的内容时；

Other individuals. This usually happens when other individuals send you a product of Laiye Technology, invite you to participate in events of Laiye Technology, or share with you content released by Laiye Technology.

2)来也科技的合作伙伴。这通常发生在您通过我们的合作伙伴购买我们的产品和服务时，或通过我们合作伙伴的引导，参加我们的论坛或活动时；

Partners of Laiye Technology. This usually happens when you purchase our products and services through our partners or participate in our forums or events through the guidance of our partners.

3) 您授权的其他渠道。这通常发生在您向来也科技发出指示，授权来也科技通过您指定的渠道收集您的个人信息时。

Other authorized channels. This usually happens when you send to Laiye Technology an instruction, authorizing Laiye Technology to collect your personal data through the channels you designated.

 除下列情形外，我们仅会在征得您的明示同意后，按照本政策规定收集和处理您的个人信息。下列情形下，我们将依据所适用的法律法规履行我们的义务，无需再征得您的同意。

We will only collect and process your personal data in accordance with this Policy with your express consent except for the following circumstances. While in the following circumstances, we will perform our obligations in accordance with applicable laws and regulations without seeking for your consent.

1）根据您的要求订立和履行合同所必要的；

Necessary for signing and performing contracts at your request;

2）履行法定义务所必要的，如反洗钱、反诈骗、实名管理等相关法律法规要求的必要信息；

Necessary to fulfill statutory obligations, such as information required by relevant laws and regulations on anti-money laundering, anti-fraud, personal identity management, etc.;

3）为应对公共卫生突发事件，或者紧急情况下为保护自然人的生命健康和财产安全所必要的； 

Necessary to respond to public health emergencies, or to protect individuals’ lives, health and properties in emergency;

4）为公共利益在合理范围内处理个人信息，如配合进行犯罪侦察；维护国家安全、国防安全等；

Personal data being processed to a reasonable extent for the public interest, such as assisting criminal investigation, national security and national defense;

5）个人信息是您自行公开的，或从合法渠道公开披露的，如政务系统、新闻报道等；

Personal data being disclosed by yourself, or via legitimate public channels such as governmental bodies and media reports; and

6）法律法规规定的其他情形。

Other circumstances stipulated by laws and regulations.

四、我们如何使用个人信息

IV. How we use personal data

我们可能出于实现产品功能和服务目的、为产品和服务提供支持、处理您的交易、与您沟通、遵守法律要求、和其他您明示同意的目的，使用您的个人信息。当个人信息处理目的发生变化时，我们将立即通知您，并在再次征得您的同意的前提下继续使用您的个人信息。

We may use your personal data for achieving product features and services, providing support for products and services, processing your transactions, contacting you, complying with applicable laws and regulations, and other purposes for which you have expressly agreed. Where there is a change in the purpose of personal data processing, we will immediately notify you and, continue to use your personal data only with your new consent.

我们亦可能在特定的产品、服务或网页中利用您的个人信息进行自动化决策，我们保证此类自动化决策是透明的，其产生的结果是公平、公正的。我们通过自动化决策方式作出的决定不会对您的个人权益产生重大影响，并且我们不会依据此类自动化决策的结果对您实行不合理的差别待遇。

We may also use your personal data to make automated decisions for specific products, services or webpages. We promise that such automated decision-making is transparent, and the results are fair and equal. The decisions we make through automated decision-making will not have any significant impact on your personal rights, and we will not impose unreasonable differential treatment on you based on the results of such automated decision-making.

我们不会在未事先征得您同意的情况下，通过电子渠道（如邮件、短信等）向您发送来也科技的市场营销资料。订阅和退订来也科技营销资料的途径将会在产品功能、服务选项或《隐私政策特别提示》中向您提供。

We will not send you Laiye Technology’s marketing materials through digital channels (e.g., emails and text messages) without your prior consent. The channels to subscribe and unsubscribe from receiving Laiye Technology’s marketing materials will be provided to you in the product features, service options or “Special Reminders for Privacy Policy.”

五、我们如何保护和存储个人信息

V. How we protect and store personal data

我们通过管理和技术结合的双重保护措施（以下简称“信息安全保护措施”)保护您的个人信息安全。具体而言，管理措施包括信息安全制度、保密制度、员工行为规范、信息安全事故预案等，且我们已成立信息安全委员会负责落地执行前述管理措施；技术措施包括SSL链路加密、证书与密码双重保护根据不同用途被相互隔离的VPN专有网络、数据中心权限控制等。我们在制定信息安全保护措施的过程中，就不同种类个人信息的性质、保密等级、泄露后果等进行了考量，且分别制定了相适应的信息安全保护措施。

We have implemented a dual protection mechanism combining management and technical tools (hereinafter referred to as the “information security measures”) to protect your personal data. In particular, the management measures are consist of information security policy, confidentiality policy, employee’s code of conduct, information security incident plans, etc., and we have established an Information Security Management Committee to take in charge of the  foregoing management measures. The technical measures include SSL link encryption, VPN private networks with double protection of certificate and password that are isolated from each other according to different purposes, authority control of data center, etc. We have considered the nature, classification, and consequences of leakage for different types of personal data, so to establish information security measures accordingly and respectively for various circumstances.

六、我们如何共享个人信息

VI. How we share personal data

来也科技旗下各关联公司间可能会共享您的个人信息（以下简称“集团内共享”）。在事先获得您明确同意的情况下，集团内共享仅限于以下情形：

Your personal data may be shared among affiliated companies represented by Laiye Technology (hereinafter referred to as “Intra-group Share”). With your prior express consent, Intra-group Share is limited to the following circumstances:
1）向您提供产品、服务所必要的共享。特定产品和服务可能由我们旗下的多家法律实体共同提供，因此只有在集团内共享您的个人信息，才能向您提供所需的产品和服务；
Intra-group Share may be necessary for providing you with certain products and services, which may be provided jointly by several affiliated companies represented by Laiye Technology. In such cases, we can provide you with such products and services only if your information is shared within the group. 
2）您参加来也科技旗下多家法律实体共同主办的运营活动，如论坛、抽奖等。您的个人信息将在主办这些运营活动的法律实体间进行集团内共享；
When you participate in events (such as forums and lucky draws) co-hosted by several affiliated companies represented by Laiye Technology, your personal data will be shared among the hosting companies.
3）在法律法规允许且不违反公序良俗的范围内，依据您的授权范围进行集团内共享。
Intra-group Share may be conducted with your authorization to the extent permitted by laws and regulations, and such share will be reasonable and in good faith.

同时，未经您同意，除下列情形外，我们不会与任何第三方共享您的个人信息：

Meanwhile, without your consent, we will not share your personal information with any  third parties except under the following circumstances:

1） 我们可能将您的个人信息与来也科技旗下的关联公司、第三方服务商和代理共享，用于以下用途：

We may share your personal information with affiliates, third-party service providers and agents of Laiye Technology, for the following purposes:

（a）提供相应产品和服务所必须；
   To the extent necessary , the provision of relevant products and services;

（b）履行我们和您的合同所必须；
   To the extent necessary, our performance of the contracts entered between you and us;

（c）本政策项下，履行义务和行使权利；

    The fulfillment of our obligations and exercise of our rights under this policy;

（d）为了提升信息处理效率，降低信息处理成本，提高信息处理的准确性，我们可能委托具有能力的
第三方专业机构代表我们处理您的个人信息。若我们拟委托第三方专业机构处理您的个人信息，我们将事先征得您的同意。在征得您同意的前提下，我们将通过书面协议、现场审计等方式要求受托机构采取信息安全保护措施保护您的个人信息，且在委托关系解除时，受托机构以安全的方式将这些信息退还给我们或按我们的要求进行销毁；
We may engage third-party professional agencies to process your personal data on behalf of us to improve the efficiency and accuracy of data processing, and to reduce costs. Your personal data will not be transferred to such third-party professional agencies without your prior consent. With your consent, we will require the third-party professional agencies to take information security measures to protect your personal data by means such as written agreements and on-site audits, and when the principal-agent relationship is terminated, require the professional agencies to return or destroy such information per our instructions.

（e）在事先征得您同意的情况下，我们会和第三方共享您的个人信息。请特别注意，通过我们接入的第三方服务（例如：交易相对方、第三方网站经营者、第三方购物平台运营者等）和通过我们接收您个人信息的第三方可能有自己的隐私政策。当您查看第三方创建的网页或使用第三方开发的应用程序时，此类第三方可能会收集、存储、传输、使用或以其他方式处理您的个人信息，且这些个人信息的处理不受我们的控制，亦不受本政策的约束。我们将尽合理的商业努力要求此类第三方采取保护措施保护您的个人信息，但我们无法保证第三方对这一要求的执行。您可与此类第三方联系获取他们的隐私政策。当您认为允许此类第三方处理您的个人信息存在风险时，建议您终止相关操作以保证您的合法权益。
With your prior consent, we may share your personal data with third parties. Please note that the third-party services (e.g., services provided by counterparties of transactions, third-party website operators, third-party shopping platform operators, etc.) you access through us and the third parties that receive your personal data through us may have their own privacy policies. When you view a webpage operated by a third party or use an application developed by a third party, such third party may collect, retain, transfer, use or otherwise process your personal data, and such processing of personal data is neither under our control nor subject to this Policy. We will make reasonable commercial effort to request such third parties to take measures to protect your personal data. However, we cannot guarantee that they will honor such requests. You can contact such third parties to review their privacy policies. If you consider it risky to allow such third parties to process your personal data, we suggest that you cease relevant operations to protect your legitimate rights and interests.

根据相关法律等规定，在以下情形中，我们可在未经您同意的情况下，共享、转让或公开披露您的个人信息：

We may, without our consent, share, transfer, or disclose your personal information, in accordance with relevant applicable laws and regulations, under the circumstances listed below:

a）履行法定义务，如执行执法机关的要求；
For the purpose of fulfilling statutory obligations, such as orders issued by law enforcement agencies;

b）与国家安全、国防安全直接相关的；
For the purposes that directly relate to national security and defense

c）与公共安全、公共卫生、公共利益直接相关的；
For the purposes that directly relate to public safety, public health, and public interests;

d）与刑事侦察、公诉、判决和执行等直接相关的；
For the purposes that directly relate to criminal investigation, prosecution, sentences, and enforcement.

e）出于维护您或其他自然人生命、财产等合法权益的；
For the purposes of protecting you or other individual’s life, property, and other legitimate interests;

f）您自行向社会公众公开的个人信息；
Your information has been publicly disclosed by yourself;

g）您的个人信息已被第三方合法公开披露，如新闻报道、政府公开信息等。
Your information has been legitimately disclosed by a third party to the public, such as news, public information disclosed by the government, etc.

除非法律另行规定，来也科技不会向香港特别行政区、澳门特别行政区、台湾省及境外的国家和地区共享您的个人信息。

Unless otherwise stipulated by law, Laiye Technology will not transfer any personal data collected in Mainland China to other countries or regions, including Hong Kong Special Administrative Region, Macau Special Administrative Region, and Taiwan Province.

如果您是香港特别行政区、澳门特别行政区、台湾省或境外国家和地区的用户，我们可能会向境外相关国家、地区跨境传输您的个人信息，以使您可以使用我们的产品和服务。我们将严格遵守相关国家或地区对于信息跨境传输的法律法规。如相关国家或地区法律法规与本政策内容不符，我们将按前者执行。

If you are a user in Hong Kong Special Administrative Region, Macau Special Administrative Region, Taiwan Province, or a country or region outside of China, we may transfer your personal data across border so that you can use our products and services. We will strictly abide by the laws and regulations of relevant countries or regions on cross-border data transfer. If the laws and regulations of the relevant countries or regions are inconsistent with this Policy, the former shall prevail.

我们认可并尊重您的隐私权。这项基本权利不会因您生活在不同的国家和地区而受到我们不同的对待。

We recognize and respect your privacy right, which will not be treated differently based on where you live.

您可通过本政策所载的联系方式与我们取得联系，对来也科技收集、存储、使用、或以其他方式处理的您的个人信息进行查阅、更正、补充、删除等。请特别注意，我们仅在对您的身份和所提供的信息进行核实后，才会响应您的请求，这是我们保证信息安全的重要流程之一。同时，部分产品和服务的功能可能由于您的请求而难以实现或受到限制。我们会在您发出此类请求时向您提示，以免影响您正常使用我们的产品和服务。

You may, by reaching out to us via the contact information stated herein, review, correct, supplement, delete or otherwise process your personal data that is collected, stored, used, or otherwise processed by Laiye Technology. Please note, we will only respond to your request after verifying your identity and provided information. This is one of our key information security mechanisms. At the same time, some features of the products and services may be unachievable or restricted due to your request. We will remind you when you make such a request, so as not to affect your normal use of our products and services.

尽管有上述规定，但按照相关法律法规和国家标准，我们在以下情形中可能无法响应您的要求。

Notwithstanding the foregoing, we may not be able to respond to your request in the following circumstances in accordance with relevant laws, regulations and national standards.

1）与国家安全和国防安全直接相关的；

Your request is directly related to national security or national defense.

2）与公共安全、公共卫生、重大公共利益直接相关的；

Your request is directly related to public safety, public health, or significant public interests.

3）与犯罪侦察、起诉、审判和执行判决直接相关的；

Your request is directly related to criminal investigation, prosecution, trial or enforcement of judgments.

4）响应您的请求将导致其他自然人、法人或法律实体受到严重损害的；

The response to your request will have adverse impact on other individuals, companies or legal entities.

5）涉及商业秘密的。

Your request relates to trade secrets.

We are well aware of the importance of protecting the personal data of minors, and will protect the personal data of minors in accordance with applicable laws and regulations. Meanwhile, we expect parents and guardians to guide and instruct their minors when using our products and services.

如果您是未成年人，建议您和父母或监护人共同阅读本政策，并在征得您父母或监护人同意的前提下使用我们的产品和服务，或向我们提供您的个人信息。我们将仅在您的父母或监护人明确同意后，在此类同意和法律允许的范围内处理您的个人信息。如您的父母或监护人不同意您按照本政策使用我们的产品和服务，或向我们提供您的个人信息，请立即终止相关的使用和披露，并及时告知我们，以便我们采取相应措施。

If you are a minor, we highly suggest that you read this Policy together with your parents or guardians, and use our products and services or provide us with your information with their consent. We will only process your personal data with the express consent of your parents or guardians to the extent allowed by such consent and applicable laws. If your parents or guardians do not approve that you use our products or services in accordance with this Policy or provide us with your personal data, please immediately cease the use or disclosure, and promptly inform us so that we can take corresponding measures.
